These Terms & Conditions ("Terms") apply to your use of the website at e-motionpt.com (the "Site") and to the appointment and scheduling policies of E-Motion Physical Therapy & Wellness ("E-Motion," "we," "us," or "our"). E-Motion is the name under which two practices operate: E-Motion Physical Therapy PC (our New York clinic) and Kalpraj Healthcare LLC (our Jersey City clinic). "We" means the practice whose clinic you contact or visit, and both practices for the Site. By using the Site or requesting an appointment, you agree to these Terms. If you do not agree, please do not use the Site.

1. Information only, not medical advice

The Site, including our blog, FAQ and service descriptions, is for general information and is not medical advice, diagnosis or treatment. Reading the Site or submitting a form does not create a patient-provider relationship. That relationship begins only when a licensed clinician evaluates you at one of our clinics. Always seek the advice of a qualified provider about a medical condition.

If you think you are having a medical emergency, call 911. Do not use the Site or our forms for urgent needs.

2. Appointment requests

Submitting an appointment request does not book or guarantee a visit. We follow a request-and-confirm process: our front desk contacts you by phone, text or email to confirm an exact date and time. Your appointment is scheduled only once we confirm it. New York and New Jersey are direct-access states, so a physician referral is not required to schedule a physical therapy evaluation, although we may recommend that you see another provider if appropriate. Physical therapy visits are currently in person only at our New York (FiDi) and Jersey City (Journal Square) clinics.

3. Messaging

By giving us your mobile number and submitting a request, you agree that E-Motion may text you about your request, scheduling and appointment reminders. Message frequency varies with your requests and appointments. Message and data rates may apply, depending on your carrier and plan. Consent to texting is not a condition of receiving care. You can opt out at any time by replying STOP to a message, emailing info@e-motionpt.com or calling (201) 614-4661. Please do not include detailed medical information in text messages. 4. Accurate information

You agree to give accurate, current and complete information when you use our forms, and not to submit information on behalf of someone else without their permission. Requests for a minor must be made by a parent or legal guardian.

5. Fees, payment and insurance

E-Motion is a fee-for-service, out-of-network provider. We accept cash and check at the end of each session. We do not bill insurance directly. We can provide documentation to help you seek out-of-network reimbursement, and you are responsible for understanding your own benefits. Fees for services are provided when you schedule and are due at the time of service.

6. Cancellations and missed appointments

We ask for at least 24 hours' notice to cancel or reschedule. Cancellations made within 24 hours of your visit, and missed appointments (no-shows), are subject to a $75 fee.

7. Workshops and group services

Mobile injury prevention workshops and other group services are arranged individually. Scope, location, timing and fees are agreed with you in advance, and different cancellation terms may apply to those arrangements.

8. Testimonials and results

Reviews and testimonials on the Site reflect the experiences of individual patients. Results vary and depend on your condition, health history and participation in your plan of care. We do not guarantee any particular outcome.

9. Intellectual property

The Site and its content, including text, photographs, video, logos, graphics and design, belong to E-Motion or its licensors and are protected by law. You may view and share pages for personal, non-commercial use. You may not copy, modify, distribute or use the content for commercial purposes without our written permission.

10. Acceptable use

You agree not to misuse the Site, including by trying to gain unauthorized access, interfering with its operation, submitting false or harmful content, sending spam through our forms, or using automated tools to collect its content.

11. Suspension of access

We may suspend or restrict access to the Site or our online forms at any time, without notice, if we believe these Terms have been violated or the Site is being misused.

12. Third-party links and services

The Site links to and embeds third-party services such as Google Maps and Instagram. We do not control them and are not responsible for their content, availability or practices. Your use of them is subject to their own terms.

13. Disclaimer of warranties

The Site is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components.

14. Limitation of liability

To the fullest extent permitted by law, E-Motion and its owners, clinicians and staff are not liable for any indirect, incidental, special or consequential damages arising from your use of the Site or reliance on its content. Nothing in these Terms limits liability that cannot be limited by law, or limits your rights in connection with the professional care you receive at our clinics.

15. Privacy

Our Privacy Policy explains how we collect and use information and is part of these Terms.

16. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law principles, except that any dispute relating to services at our Jersey City clinic or to Kalpraj Healthcare LLC is governed by the laws of the State of New Jersey. Disputes will be brought in the state or federal courts located in New York County, New York (for the New York clinic and the Site) or Hudson County, New Jersey (for the Jersey City clinic), and you consent to their jurisdiction.

17. Changes to these Terms

We may update these Terms from time to time. The current version is always available at e-motionpt.com/terms, and the effective date above shows when it last changed. Continuing to use the Site after a change means you accept the updated Terms.
